Digital Message Kiosk Consultants Program
Legal Disclaimer, Liability Waiver & Indemnity Agreement

Applies to: All persons worldwide who identify themselves as Digital Message Kiosk Consultants, DMK Consultants, messagekiosk Consultants, or any similar title.
1. Independent Consultant Status
By participating in or presenting themselves as part of the Digital Message Kiosk Consultants Program (“DMK Program”), all Consultants acknowledge and agree that:
- They operate independently, under their own name, own business, or own brand.
- They are not employees, not agents, not partners, and not representatives of messagekiosk.com, HOWS.cc, HOWIS.cc, or any related platform.
- They are not authorized to act on behalf of messagekiosk.com or to enter into agreements, promises, financial arrangements, or obligations on behalf of messagekiosk.com.
messagekiosk.com provides access to the Digital Message Kiosk system only. Consultants work for themselves.
2. No Liability for Consultant Actions
MessageKiosk.com shall not be held liable for any action, omission, statement, representation, guarantee, misconduct, or behavior by any Consultant, including but not limited to:
- Their pricing, invoices, or charges
- Their statements or promises made to clients
- Misrepresentation of the Digital Message Kiosk system
- Incorrect usage or misunderstanding of the platform
- Design work, content creation, or advisory services performed by the Consultant
- Losses, damages, or disputes arising between the Consultant and their clients
- Any legal, regulatory, tax, or compliance issue connected to the Consultant’s business
- Any advice, technical assistance, or service provided by the Consultant
Each Consultant is fully responsible for their own work, business operations, and conduct.
3. No Guarantees of Earnings or Client Results
MessageKiosk.com:
- Does not guarantee any earnings or income to Consultants.
- Does not guarantee client satisfaction, business growth, marketing results, or any outcome related to the use of Digital Message Kiosks.
- Is not responsible for any promises, claims, or expectations created by Consultants.
All marketing claims or assurances made by Consultants are made at their own risk.
4. Consultant Responsibilities
All Consultants must ensure that their activities comply with:
- Local business and tax regulations
- Local advertising, data protection, and consumer laws
- Ethical conduct and truthful representation of the Digital Message Kiosk system
MessageKiosk.com bears no responsibility for verifying any Consultant’s qualifications, registrations, history, or legal compliance.
5. No Commission, No Partnership, No Control
MessageKiosk.com does not:
- Collect commissions
- Share revenue
- Supervise consultants
- Manage client relationships
- Train consultants beyond publicly available materials
- Assume any responsibility for Consultant decisions
Consultants run their own business entirely at their own discretion and risk.
6. Platform Use and Limitations
The Digital Message Kiosk system is provided as-is. MessageKiosk.com is not responsible for:
- Technical issues, outages, or interruptions
- Scanning errors, message delivery problems, or QR code misreads
- Loss of content, delays, or system limitations
- Third-party sharing or distribution of messages
Businesses and Consultants use the system at their discretion.
7. Indemnification
All Consultants agree to indemnify, defend, and hold harmless:
- MessageKiosk.com
- Its owners, founders, developers, and partners
- Its subsidiaries, affiliates, and platforms (including HOWS.cc, HOWIS.cc)
From any claim, loss, liability, damage, cost, legal fee, or dispute arising from:
- Their participation in the DMK Program
- Their interactions with clients
- Their marketing activities
- Their conduct, negligence, or misuse of the kiosk system
- Any contractual or financial arrangement they enter
This indemnity applies globally and permanently.
8. Right to Revoke Consultant Status
MessageKiosk.com reserves the full, unconditional right to:
- Withdraw, revoke, or terminate a person’s participation as a Consultant
- Deny approval or remove any Consultant from the Program
- Prohibit use of the Consultant title
- Restrict access to any Consultant-related materials
Such revocation may occur with or without notice, and for any reason, including:
- Misconduct
- Misrepresentation
- Fraud
- Ethical violations
- Actions harmful to the Digital Message Kiosk brand
Revocation does not obligate MessageKiosk.com to provide explanation or justification.
9. No Legal Claims Against MessageKiosk.com
By reading, joining, participating in, or presenting themselves as part of the DMK Program, all Consultants agree that:
- They waive any right to sue MessageKiosk.com
- They waive any right to pursue legal claims related to their activities
- They acknowledge that they are acting independently and at their own risk
- They accept full personal, financial, and legal responsibility for their actions
MessageKiosk.com operates solely as a platform provider and has no role in Consultant-client transactions.
10. Acceptance of Terms
Any Consultant who:
- Views the Consultant Program
- Uses the Digital Message Kiosk system
- Promotes or introduces the system
- Calls themselves a Digital Message Kiosk Consultant
- Works with businesses using Digital Message Kiosks
Is automatically deemed to have read, understood, and accepted every term in this document. Participation equals agreement.
Conclusion
By continuing as a Consultant, you acknowledge that:
- You operate fully independently
- You hold full responsibility for your business
- MessageKiosk.com is protected from all Consultant-related liability
- MessageKiosk.com may revoke your participation at any time
This document exists to clearly protect the Digital Message Kiosk ecosystem, preserve fairness, and ensure that all Consultants act responsibly and ethically while maintaining their independence.
